Consumer Health Data Privacy Statement

This Consumer Health Data Privacy Statement (the “Statement”) supplements the Church & Dwight Co., Inc. Privacy Notice. It applies to Washington, Connecticut, and Nevada consumers with respect to consumer health data collected in those states. This Statement uses certain terms that have the meaning given to them in the Washington My Health My Data Act (the “MHMDA”), Connecticut Personal Data Privacy and Online Monitoring Act, and the Nevada Consumer Health Data Privacy Law, as applicable, and does not apply to protected health information subject to the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).
1. Collection and Use of Consumer Health Data
We may collect the following categories of consumer health data about you, including:
- If you visit our First Response website, we may collect reproductive or sexual health information based upon your visit and information you may submit to the site;
- In response to consumer claims alleging an adverse event or product defect, we may obtain the following data, if you provide it to us: individual health conditions, treatment, diseases, or diagnosis; health-related surgeries or procedures; use or purchase of prescribed medication; bodily functions, vital signs, symptoms, or measurements of the information described in this section of the Statement; diagnoses or diagnostic testing, treatment, or medication;
- Data that may otherwise identify your health status (such as search terms or queries that you enter into search fields or chat features on our websites, interactive product selectors and quizzes, product support, survey answers, product sample requests, or products that relate to specific health conditions); and
- Any information that we process, including through algorithms or machine learning, to associate or identify you with the data described above that we obtain from non-health information.
We may collect and use consumer health data for the purposes described above, to provide you with the products and services you request, and for the purposes described in the Church & Dwight Co., Inc. Privacy Notice. Where required by applicable law, we will obtain your consent to collect and use your consumer health data.
We may allow certain third parties (such as our online advertising partners), to collect your consumer health data via automated technologies for cross-context behavioral advertising when you use or visit our websites or online services, to the extent permitted by law. These third parties may also collect your data over time and across different third-party websites or online services not owned or operated by us. You may opt-out of such automated technologies through our Privacy Preference Center ("Your Privacy Choices") on each site to which this policy applies. Note, however, your opt-out will be specific to the website or online service and browser or device you are using when exercising your opt-out.
2. Sources of Consumer Health Data
We may collect consumer health data about you from:
- you or your devices (for example, through your use of our products, services and apps, websites, customer service calls and our "Contact Us" feature);
- your friends, through our "tell-a-friend" tool;
- social networks;
- online advertising companies and advertising networks;
- sweepstakes and contests, affinity groups, or other marketing campaigns;
- third-party devices and apps you choose to connect to our services; and
- our affiliates and subsidiaries.
3. Sharing of Consumer Health Data
We may share the categories of consumer health data described in Section 1 of this Statement with the parties described in the Church & Dwight Co., Inc. Privacy Notice. We also may share consumer health data with our Waterpik affiliate. Where required by applicable law, we will obtain your consent to collect, use and share your consumer health data.
4. Consumer Rights
You have certain rights and choices regarding your consumer health data, as described below.
- Confirm: You have the right to request that we disclose to you whether we collect, share or sell your consumer health data.
- Access: You have the right to request access to, and information about, the consumer health data we have collected or shared about you, including a list of third parties and affiliates with whom we have shared your consumer health data, and contact information for such third parties and affiliates.
- Delete: You have the right to request that we delete your consumer health data.
- Withdraw: If, where required under applicable law, you have provided your consent to Church & Dwight to collect, use and share your consumer health data, you have the right to withdraw your consent.
- Restrict: For Nevada residents, you have the right to request that we cease the collection, sharing or sale of your consumer health data.
- Correct: For Connecticut and Nevada residents, you have the right to review and request changes to your consumer health data.
